The rules for using LeadStreamIQ.

These Terms of Use (“Terms”) govern access to and use of the LeadStreamIQ website, platform, APIs, and related services (collectively, the “Services”) operated by LeadStreamIQ (“LeadStreamIQ,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to be bound by these Terms.

1. Eligibility and Business Use

The Services are intended for business and commercial use only. By using LeadStreamIQ, you represent that:

• You are at least 18 years of age
• You have authority to bind the business or entity you represent
• You will use the Services in compliance with applicable laws

2. Account Registration and Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity occurring under your account
• Ensuring authorized users comply with these Terms

LeadStreamIQ may suspend or terminate access if we reasonably believe your account has been compromised or misused.

3. Description of Services

LeadStreamIQ provides a lead ingestion and processing platform that may include:

• Email ingestion
• API-based lead intake
• Web form processing
• Lead normalization, validation, and routing
• Delivery to CRMs, DMS platforms, or other systems

LeadStreamIQ does not guarantee lead quality, accuracy, conversion rates, or sales outcomes.

4. Customer Responsibilities

You agree that you:

• Own or have lawful rights to all data submitted
• Have provided required disclosures and obtained necessary consents
• Will not submit unlawful, harmful, or infringing content
• Will comply with all privacy, marketing, and data-protection laws

5. Acceptable Use

You may not:

• Use the Services for spam, fraud, or harassment
• Attempt to reverse engineer or disrupt the platform
• Circumvent security, rate limits, or access controls
• Use the Services to violate any law or regulation

6. Fees and Payment

Certain features require payment. Unless otherwise stated:

• Fees are non-refundable
• Usage-based fees may be billed in arrears
• You are responsible for all applicable taxes

7. Third-Party Services

The Services may integrate with third-party platforms. LeadStreamIQ is not responsible for third-party availability, performance, security, or data handling.

8. Intellectual Property

LeadStreamIQ retains all rights, title, and interest in the Services, software, trademarks, and documentation. You are granted a limited, non-exclusive, non-transferable license to use the Services during your subscription term.

9. Confidentiality

Each party agrees to protect the other’s confidential information and use it solely to perform under these Terms.

10. Data Processing and Privacy

LeadStreamIQ processes personal data in accordance with its Privacy Policy. A separate Data Processing Addendum may apply.

11. Service Availability

The Services are provided on an “as is” and “as available” basis. LeadStreamIQ does not guarantee uninterrupted or error-free operation.

12. Disclaimer of Warranties

To the maximum extent permitted by law, LeadStreamIQ disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, LeadStreamIQ shall not be liable for indirect, incidental, or consequential damages. LeadStreamIQ’s total liability shall not exceed the fees paid by you in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless LeadStreamIQ from claims arising out of your use of the Services, data you submit, or violation of these Terms.

15. Termination

Either party may terminate access for material breach. Upon termination, your access will be disabled and outstanding fees remain payable.

16. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

17. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services constitutes acceptance of the revised Terms.
